Lease Agreement Conflicts

We often say that not every business arranges an adequate lease. It may occur that, due to this commitment (the lease), the other party may default, incorrectly observe their obligations or completely ignore them. In such a case, it is essential to have a lawyer who specialises in leaseholding.

A lease can be oral or written. An oral agreement carries the same obligations as a written one. In practice, however, an oral contract is much more difficult to prove. For that reason, written contracts are much more preferable. However, whether it is oral or written, it is no superficial luxury to evaluate the legal consequences before committing yourself to it.

Leaseholding breaks down into two categories based on their places of business: commercial establishments and other places of business. Examples of commercial establishments are stores, hotels, and craft businesses.

The other places of business are, for example, offices, banks, most trading companies, and factories. In addition to the general provisions, other laws whose nature is also imperative apply to various objects. In practice, commercial establishments are often the object of legal controversy.

The Law of the Netherlands offers a comprehensive legal protection to tenants. As a landlord, you cannot withdraw your tenant's contract arbitrarily. Some cases that we frequently resolve are: delays in rent payment, maintenance of the rented building, term of the contract and the form of withdrawal as well as the cost of rent, business transference, succession conflicts, debt collection, and eviction in the case of nuisance.
